Re refused credit staying on file for 3 months - sorry dudes but the Privacy Act forbids credit reporting agencies being allowed to record whether credit has been granted or denied.

The fact that someone CHECKED your credit status, when and by whom, stays on your credit record for 5 years.

dozer - I have no problems with the fact I have an unpaid bill - as part of cleaning up the wreckage of my past, I am quite happy to pay it.  I do have a problem with companies being able to root your credit history for 5-7 years (depending on whether it is a default or clearout) over $160, especially when the default arises under unfortunate circumstances.

I believe it more than fair that a company has the opportunity to list me for an unpaid bill - but noone is going to convince me it is fair that it stays on my record for 7 years, even if it is paid as soon as I am aware of it.

If we were talking REAL amounts of money eg more than $1000 that would probably be different in my opinion, but not for freakin' $160!

I mean, here I am, I am now working 2 jobs, can quite easily afford to pay off a scooter, and I have to screw around trying to attain finance for one!

Thankfully with one of my jobs I am self-employed, so I can use the scooter as an expense to minimise tax - so when I actually CAN attain finance, I really have no qualms with purchasing a Gmax 150/250 or similar.

Still stuck in the game of screwing around with this damn factoring company.  Awaiting reply to letter requesting proof of claim.

Exactly 1 month to go before original debt removed from credit file.  3 more years with secondary debt (if they can substantiate claim).  No matter what I will pay off primary debt, even though the statute of limitations releases me from their claim to the debt after 6 years, which happens in 4 months.

I am freaking out a bit over this second debt - Alliance Factoring are well known for creating imaginary debts, and being forced to remove them from Baycorp Advantage (which actually own AF).  I am HOPING this is what it is, the only other option is that I am a victim of identity fraud...You see I haven't had a telecommunications account (phone) since beginning of 2002 (only telecomms acct since then is an ADSL connection which I have always paid for in advance, and my AAPT home phone which I took over from my wife's name when I bundled my ADSL) - but Alliance Factoring listed me for $330 on 14-03-2005, on a different account number!

As a previous business owner, I was always chasing up money. I had a debt collector go after someone over $200. After fees, I recovered about $50, so It was just the point I wanted made, Dont F$%k with Dozer. I think next time, I'll send round some Bikies I know, much cheaper. Better still rock up beind them on their Harleys with my BeeWee, and try to look tough, hehehe. I can see your situation, but unfortunately, we all suffer the ramifications of our earlier days! Round One:

Talked to Alliance Factoring - the first-listed debt is to be automatically removed from my credit history on the 7th June - AF have made a settlement offer of half the debt if I pay before June 12th.  I asked them what happens if I pay now - they said it would be added to my credit record, would come off in November.  Essentially if I wait until after June 7 and pay before June 12, that debt will disappear and the first part of my credit record will be cleared.

The second debt - that's a tricky one - looks like it might be mine, it was a phone in my name but my wife had it.  While we were separated she stopped paying for it and unbeknownst to me, Telstra got rather cranky about it.  My Father transferred it into his name, and used it for himself.

Telstra didn't list the debt with Baycorp Advantage, it was only listed in 2005 when AF bought it.

HOWEVER - it looks like AF made no attempt to contact me before listing the debt, which they are required to do.   They contacted me this time around by checking my credit file at Baycorp Advantage - which had my current address before they listed the second debt.  As such they did not make an effort to find me, which they must do before listing me as a default.

I have asked for proof of claim, as well as evidence that they attempted to contact me before listing the debt.  They have sent me a letter to grant them permission to contact Telstra in regards to this debt.

The problem with the letter is that it is worded in such a way that if I was to sign the section granting them authority, I would be in fact accepting that I am the owner of the debt.  As such I will not sign it.

So now I go into Round Two, I will call them tomorrow and explain that the onus is on them to prove I owe any monies, and whether the debt is mine in the first place.  I cannot grant authority to gain documentation for a debt I say I do not owe.  (Yes I know, I most likely do owe it, but give them an inch and they will take a mile)

They must substantiate all efforts to contact me regarding the debt before they listed it with Baycorp Advantage, or they have breached the Privacy Act, and must remove it immediately.

So hopefully I will convince them that they should remove the second listing, at which time I will pay it in full, to get them off my backs and to clean up my past.

While I would sorely like this cleared up quickly so as to obtain credit, I would much prefer a clear credit history.  So I must play the game, and accept that the process takes time.

It looks like you may have worked out how to get through these problems and get a clear credit history shortly. I hope it all works out and you get on a scooter shortly.

Woohoo!  D-Day!

My first bad credit listing came off today - rang up Alliance Factoring and told them I was accepting their settlement offer, paid it via BPay (even though the listing came off Baycorp, their claim to the money still stands so I have cleared it now)

The second one - well it seems Veda didn't have my current address information when they listed the default, so I am going to have to pay them off.  Right now I am in the process of pissing them off enough that they will accept half payment as a settlement offer.

This one isn't going to go away, but it will look much better to a credit provider once it is paid.

Gee Alliance Factoring are sneaky - every person I have spoken to there is Indian, some with very thick accents and I have a mild hearing problem due to many ear infections as a child and too much rock music!  They always start with "we need to verify your identity" - which ends up going from name, address, date of birth to employer ("I choose not to give you that information"), mobile phone number ("I choose not to give you that information"), email address ("I choose not yo gove you that information").

As if I'm silly enough to give them extra ways to harass me - it's illegal for them to contact you at work, but they do anyway as the ACCC is well aware...I don't want to be getting calls on my mobile phone or my email address becoming inundated...

The guy on the phone today told me the settlement offer ran out on May 29 - I explained to him that the letter did not say that and it runs out on June 12 - he disagreed and threatened me until I requested that he bring up the letter on his computer - once he did it all changed to "ok, you are correct - would you like to give me your credit card number now?"

"Ummmmm - no.  Not if hell freezes over mate, you will deduct the full amount and I will have to take you to court to get it back!"  Well, that's what I could have said - instead I told him I would BPay the settlement amount, which I did this arvo.

I'm checking out a GMax 150 tomorrow (private sale), and hopefully a Peugeot Jetforce 125 (car yard), both with extremely low km.  Wish me luck!

Well, I took a GMax 150 for a ride today - the guy bought it for his wife, but when he upgraded to a Burgman 650, she moved onto his Bolwell Firenze 250 - as such there is a lovely, 1450kms 150 sitting there...

Looks like I have bypassed the credit cards etc - Mum & Dad just offered to loan me the $3000 I need on top of my savings!

So hopefully by Tuesday I will be riding a GMax!  Ummm - make that after I get my RE(A) licence...

I'm not even a Guru's hangnail...
